Sales and Delivery Terms for The Greenery I\/S (April 2024)<\/p>\n\n\n\n
\u00a7 1.1 The following general sales and delivery terms apply unless otherwise agreed in writing. The customer’s statement of special terms in orders, etc., is not considered a deviation from the following conditions unless The Greenery I\/S has accepted them in writing.<\/p>\n\n\n\n
\u00a7 2.1 An agreement between The Greenery I\/S and the customer is considered concluded when The Greenery I\/S has received the customer’s acceptance of its offer.<\/p>\n\n\n\n
\u00a7 3.1 For webshop payments, half of the purchase amount is charged upon order confirmation. The remaining half is reserved on the payment card and charged when the product is shipped from The Greenery I\/S’s warehouse. For consumers, the entire amount is charged upon dispatch.<\/p>\n\n\n\n
\u00a7 3.2 For invoice payments, half is paid on the first working day after agreement, and the remaining half no later than one week before greenhouse installation.<\/p>\n\n\n\n
\u00a7 3.3 If the customer does not pay by the due date, The Greenery I\/S may withhold its service and charge default interest as per the Danish Interest Act. A reminder fee of DKK 100.00 per notice will be added in accordance with \u00a7 9 b, subsections 1 and 2 of the Interest Act.<\/p>\n\n\n\n
\u00a7 3.4 The customer may not withhold any part of the purchase sum as security for claims related to other deliveries, which will be considered a significant breach of contract.<\/p>\n\n\n\n
\u00a7 4.1 Orders may only be changed or cancelled after acceptance by contacting The Greenery I\/S in writing.<\/p>\n\n\n\n
\u00a7 4.2 In case of cancellation or changes, the customer must cover The Greenery I\/S\u2019s costs, losses, and lost profit, with a minimum of 10% of the agreed price excluding VAT.<\/p>\n\n\n\n
\u00a7 4.3 Consumers have a 14-day right of withdrawal when purchasing via webshop, starting from receipt of the product. Notification must be sent in writing via email to info@thegreenery.dk.<\/p>\n\n\n\n
\u00a7 4.4 The customer must return the product without undue delay, and no later than 14 days after notifying the withdrawal. The customer is responsible for proper packaging and shipping. Return shipping costs are borne by the customer.<\/p>\n\n\n\n
\u00a7 4.5 If the product is returned in a diminished state due to handling beyond what is necessary to determine its nature and function, the customer will be liable for the depreciation, which will be deducted from the refund.<\/p>\n\n\n\n
\u00a7 5.1 The Greenery I\/S designs and develops its products, with ongoing improvements. Minor deviations from photos and materials may occur.<\/p>\n\n\n\n
\u00a7 6.1 Unless agreed otherwise, delivery times are estimates. If a delay is expected, the customer will be notified in writing with an estimated new delivery time.<\/p>\n\n\n\n
\u00a7 6.2 Delays up to 30 days caused by The Greenery I\/S are considered timely delivery.<\/p>\n\n\n\n
\u00a7 6.3 Delays due to customer-related issues are also considered timely delivery.<\/p>\n\n\n\n
\u00a7 6.4 Delays caused by the customer that result in a failed visit by a technician will incur charges for lost time and travel costs.<\/p>\n\n\n\n
\u00a7 6.5 The Greenery I\/S is not liable for any losses the customer may suffer due to delay or non-delivery.<\/p>\n\n\n\n
\u00a7 7.1 The customer is responsible for ensuring compliance with local rules on placement, building height, etc.<\/p>\n\n\n\n
\u00a7 7.2 The greenhouse must be placed safely, away from potential falling debris (e.g., from trees).<\/p>\n\n\n\n
\u00a7 7.3 The installation area must be level and accessible. A slope of max. 10 cm over the length or width is allowed. The customer is responsible for ensuring the ground allows for 1-meter screws and no damage to underground utilities.<\/p>\n\n\n\n
\u00a7 7.4 The customer must prepare the area as per instructions provided before delivery.<\/p>\n\n\n\n
\u00a7 7.5 If the greenhouse cannot be placed\/installed, the customer must compensate The Greenery I\/S for their losses.<\/p>\n\n\n\n
\u00a7 7.6 Packaging and pallets may be left on the customer\u2019s property.<\/p>\n\n\n\n
\u00a7 8.1 Same responsibility as \u00a7 7.1 for compliance with local regulations.<\/p>\n\n\n\n
\u00a7 8.2 The customer is responsible for groundwork and proper foundation.<\/p>\n\n\n\n
\u00a7 8.3 The customer must treat all wooden parts and perform the assembly. The Greenery I\/S is not responsible for improper assembly or insufficient treatment. Surface treatment must be done before or within 2 months of delivery.<\/p>\n\n\n\n
\u00a7 8.4 The Greenery I\/S is not responsible for damages due to incorrect assembly or lack of maintenance. The customer is fully responsible for safe placement and maintenance per The Greenery I\/S guidelines.<\/p>\n\n\n\n
\u00a7 9.1 The greenhouse structure minimizes moisture\/sun exposure. Painted models are impregnated and treated, but being natural wood, need maintenance.<\/p>\n\n\n\n
\u00a7 9.2 The construction must not contact soil or other materials. Ground level around the greenhouse should be at least 2 cm below its base.<\/p>\n\n\n\n
\u00a7 9.3 The Greenery I\/S recommends treating external wooden strips every 2\u20133 years. Further maintenance depends on weather and location.<\/p>\n\n\n\n
\u00a7 10.1 Complaints must be made within a reasonable time after a defect is discovered.<\/p>\n\n\n\n
\u00a7 10.2 After two years from delivery, the customer can no longer claim defects.<\/p>\n\n\n\n
\u00a7 10.3 If a defect is found, The Greenery I\/S must promptly either replace or remedy it.<\/p>\n\n\n\n
\u00a7 10.4 Remedies do not apply if defects are due to misuse, poor maintenance, unauthorized modifications, or extreme weather.<\/p>\n\n\n\n
\u00a7 11.1 As wood is organic, changes like small cracks or resin may occur. Untreated wood may develop natural patina.<\/p>\n\n\n\n
\u00a7 11.2 No warranty is provided on greenhouse glass.<\/p>\n\n\n\n
\u00a7 11.3 The customer is reminded that greenhouses are single-layer constructions and not completely sealed. Leaks may occur in windows, doors, and joints depending on weather. This should be considered in interior planning.<\/p>\n\n\n\n
\u00a7 12.1 Unless mandatory rules state otherwise, any disputes will be settled under Danish law at The Greenery I\/S\u2019s venue.<\/p>\n\n\n\n
